General information about data processing 

We process your personal data in compliance with the provisions of the German Data Protection Regulation (DSGVO), the German Federal Data Protection Act (BDSG-neu) and all other applicable laws only to the extent necessary to provide the information on this website and our services on this website.

In the case of merely informational use of the website, i.e. if you do not log in to use the website, register or otherwise transmit information to us, we do not collect any personal data, with the exception of the data that your browser transmits to enable you to visit the website. These are: 

  • IP address of the user
  • Name of the website or file accessed
  • date and time of access
  • amount of data transferred
  • Message about successful retrieval
  • Browser type and version
  • Operating system of the user
  • User’s device used, including MAC address
  • Referrer URL (the previously visited page)

In order to ensure that the website functions properly, data is stored in log files. This data is also used to ensure the security of our information technology systems and for website optimisation.

– Art. 6 para. 1 lit. b) GDPR for processing operations that serve to fulfil a contract to which the data subject is a party. Included here are processing operations that are necessary for the performance of pre-contractual measures. 

– Art. 6 para. 1 lit. c)  GDPR for processing operations which are necessary for the fulfilment of a legal obligation. 

– Art. 6 para. 1 lit. d) GDPR if vital interests of the data subject or another natural person make processing of personal data necessary. 

– Art. 6 para. 1 lit. f) GDPR if the processing is necessary to protect a legitimate interest of our company or a third party and the interests, fundamental rights and freedoms of the data subject do not override the first-mentioned interest. 

Rights of the affected

According to the EU General Data Protection Regulation you have the following rights as a data subject:

  1. Right to recieve information

You have the right to receive information from us as the responsible party as to whether and which personal data concerning you are being processed by us, as well as further information in accordance with the legal requirements under Art. 13, 14 GDPR.

2. Recht auf Berichtigung

Sollten die von uns verarbeiten und Sie betreffenden personenbezogenen Daten unrichtig oder unvollständig sein, haben Sie uns gegenüber ein Recht auf Berichtigung und/oder Vervollständigung. Die Berichtigung wird unverzüglich vorgenommen.

2. Right to restriction

You have the right to restrict the processing of personal data concerning you in accordance with the legal provisions (Art. 18 GDPR).

3. Right to rectification

If the personal data we process and which relates to you is incorrect or incomplete, you have the right to have it corrected and/or completed. The correction will be made without delay.

4. Right to delete

If the grounds set out in Art. 17 of the GDPR apply, you may request that the personal data relating to you be deleted without delay. 

We would like to point out that the right to erasure does not exist insofar as the processing is necessary for one of the exceptional circumstances mentioned in Art. 17 para. 3 GDPR.

5. Right to information

If you have exercised the right to rectification, erasure or restriction of processing, we will be obliged to inform all recipients to whom the personal data relating to you has been disclosed of this rectification or erasure of the data or restriction of processing, unless this proves impossible or involves a disproportionate effort. You also have the right to be informed about these recipients.

6. Right to data portability

Under the GDPR, you also have the right to receive the personal data concerning you that has been provided to us in a structured, common and machine-readable format or to request that it be transferred to another controller.

7. Right to revoke the declaration of consent under data protection law

You have the right to revoke your declaration of consent under data protection law at any time. We would like to point out that the revocation of the consent does not affect the lawfulness of the processing carried out on the basis of the consent until the revocation.

8. Right of objection

Furthermore, you have the right to object at any time, on grounds relating to your particular situation, to the processing of personal data relating to you which is carried out on the basis of Art. 6 para 1 lit. e) or f) GDPR. 

9. Automated decision-making in individual cases, including profiling

Under the EU General Data Protection Regulation, you also have the right not to be subject to a decision based solely on automated processing, including profiling, which produces legal effects concerning you or similarly significantly affects you.

If you are of the opinion that the processing of your personal data by us is unlawful or, if applicable, violates data protection law for other reasons, you can complain to the supervisory authority responsible for us:

Data transfers to third countries (outside of the EU):

The GDPR ensures an equally high level of data protection within the European Union. When selecting our service providers, we therefore rely on European partners wherever possible when your personal data is being processed. Within some exceptions we may process personal data outside the EU through third-party services. This may only be the case where the special requirements in accordance with Art. 44 et. seq. GDPR are fully met. This means that the processing of your data may then only take place when the third country has been declared to ensure an adequate level of protection by the European Commission or if the European Standard Contractual Clauses have been signed. 

Contact form

We collect your personal data when you provide it to us by filling out the contact form. The data provided will only be processed and used to provide you with the requested information. Any further processing and use of your data for advertising purposes or market research will only take place with your express consent.

The following data is stored at the time the message is sent: 

  • IP address of the user
  • Date and time

In order to be able to process your data within the scope of the sending process, we ask for the user’s consent and refer to this data protection declaration.

Contact can also be made via an alternatively provided e-mail address, in the context of which the user’s personal data sent together with the e-mail will be stored by our company.

The legal basis for the processing of the data is Art. 6 Para. 1 lit. a) GDPR if the user has given his or her consent. If the purpose of contacting the user by e-mail is to conclude a contract, the legal basis here is Art. 6 para. 1 lit. b) GDPR.

Our company processes the personal data from the input mask solely for the purpose of and to process the contact. This is also the legitimate interest that is required for the processing if the contact is made by e-mail. The processing of further personal data during the sending process is based on the prevention of any misuse of the contact form, as well as the guarantee of the security of our information technology systems.

As soon as the data is no longer required to achieve the original purpose for which it was collected, it is deleted. Personal data collected from the input mask of the contact form on the website or sent to us by e-mail are no longer required when there is no longer any communication with the user. This is the case when it becomes clear upon consideration of the facts that this has also ended for the future and no further communication will take place.

The user can revoke his consent to the processing of his personal data at any time. When contacting us by e-mail, the user can revoke his consent to the processing of his personal data at any time. However, further communication can then no longer take place, as all personal data stored in the course of contacting us will be deleted in this case. 

Data transmitted to us in the event of interest in the delivery activity will be forwarded to the delivery companies commissioned by us.

Parts of our digital offers use Google Analytics, a web analytics service provided by Google Inc, 1600 Amphitheatre Parkway Mountain View, CA 94043, USA (“Google”). Google Analytics uses “cookies”, which are text files placed on your computer, to help the website analyse how users use the site. The information generated by the cookie about your use of the website will be transmitted to and stored by Google on servers in the United States. However, as www.nordbayern.de has activated IP anonymisation on this website, your IP address will be truncated beforehand by Google within member states of the European Union or in other contracting states to the Agreement on the European Economic Area. The legal basis for the use of Google Analytics is your consent in accordance with Art. 6 para.1 lit. a DSGVO. You can revoke your consent to Google Analytics at any time by rejecting it in the settings of our Consent Management Tool.

An opt-out cookie will be set, which prevents the future collection of your data when visiting this website: http://tools.google.com/dlpage/gaoptout?hl=de , This plug-in prevents the browser from requesting the Analytics code so that Google does not receive any data when the page is called up.
